OVERVIEW
Welcome to MAREA Sleep. The terms "we", "us" and "our" refer to
MAREA Sleep. We operate this website and online store, including
all related content, features, tools, products and services
offered through it (the "Services").

These Terms of Service, together with any policies referenced in
them, describe your rights and responsibilities when you use the
Services. Please read them carefully, because they include
important information about warranty disclaimers, limitations of
liability and how disputes are handled.

By visiting, browsing, purchasing from or otherwise using the
Services, you agree to be bound by these Terms and by our Privacy
Policy at mareasleep.com/policies/privacy-policy. If you do not
agree, please do not use the Services.

WHO WE ARE
MAREA Sleep is a brand operated by EliteLink Strategies LLC, a
Florida limited liability company. Our products are designed by
MAREA Sleep and handcrafted in the United States. You can reach us

ELIGIBILITY
You must be at least 18 years old, or the age of majority where
you live, to place an order or create an account. By using the
Services you confirm that you meet this requirement and that the
information you give us is accurate and current. You are
responsible for keeping your account credentials secure and for
all activity that happens under your account.

ONLINE STORE TERMS
You may not use our products or the Services for any unlawful
purpose, or in any way that violates the laws of your
jurisdiction. You may not transmit worms, viruses or any code of a
destructive nature, attempt to gain unauthorized access to the
Services, or use automated tools to scrape, copy or overload the
site. A breach of these terms may result in immediate termination
of your access.

PRODUCTS, PRICING AND AVAILABILITY
Our products are sold exclusively through mareasleep.com and any
authorized sales channels we operate. We have made every effort to
display our colors and images accurately, but we cannot guarantee
that your screen displays them exactly as they appear in person.
Natural fibers vary slightly in color, loft and weight from batch
to batch, and small variation is a normal feature of a handcrafted
product rather than a defect.

All prices are shown in United States dollars and may change at
any time without notice. We reserve the right to limit quantities,
to refuse or cancel any order, and to discontinue any product at
any time. In the rare case of a pricing, description or
availability error, we may cancel your order and refund you in
full, even after the order has been confirmed.

PREORDERS AND FOUNDER'S BATCH ORDERS
Some of our products are offered as preorders, including our
Founder's Batch. When you place a preorder, your payment method is
charged at checkout and your item is reserved from an upcoming
production run. Estimated ship times are shown at checkout and in
your confirmation email, and are estimates rather than guarantees.

If we cannot ship your preorder within a reasonable time of the
estimated date, we will contact you and you may either wait for
the revised date or cancel for a full refund. You may cancel a
preorder for a full refund at any time before it ships by
contacting us with your order number.

ORDERS, PAYMENT AND ORDER ACCEPTANCE
Placing an order is an offer to buy. Your order is accepted when
we send a shipping confirmation, not when you receive an order
confirmation email. Payments are processed by our payment provider
and we do not store your full card details. You agree to provide
current, complete and accurate purchase and account information,
and to promptly update it so we can complete your order and
contact you if needed.

We reserve the right to refuse or cancel any order, including
orders that appear to be placed by resellers or distributors,
orders that appear fraudulent, and orders that use a discount code
in a way it was not intended.

DISCOUNTS AND PROMOTIONAL CODES
Discount codes and automatic discounts are offered at our
discretion, are limited to the terms stated where they appear, and
may be modified, paused or withdrawn at any time. Unless we state
otherwise, codes cannot be combined with other offers, apply only
to the products they name, and have no cash value.

Codes are intended for the customers we send them to. If a code is
obtained, shared or used outside its intended terms, we may cancel
the order or reissue an invoice for the correct amount before
shipping. Discounts are not recalculated on partial returns, and
each item is refunded at the price you actually paid for it.

SHIPPING AND DELIVERY
Shipping options, costs and estimated transit times are shown at
checkout. Delivery estimates are provided by our carriers and are
not guaranteed. Risk of loss passes to you when the carrier
delivers your order to the address you provided. You are
responsible for entering a correct and complete shipping address,
and we are not liable for orders delivered to an incorrect address
you supplied.

RETURNS, REFUNDS AND THE 60 DAY SLEEP TRIAL
Returns and refunds are governed by our Return and Refund Policy
at mareasleep.com/policies/refund-policy, which forms part of
these Terms. In summary, our pillows carry a 60 day sleep trial,
covers may be returned unopened and unused within 60 days, and
kapok refill is packed by hand for your order and is not eligible
for return once shipped, except where it arrives damaged or
incorrect.

PRODUCT INFORMATION AND HEALTH
Our products are bedding and home goods. They are not medical
devices and are not intended to diagnose, treat, cure or prevent
any condition. Nothing on this site is medical advice. If you have
a medical condition, allergy or specific health concern, please
speak with a qualified healthcare professional before purchasing.

Kapok is a natural plant fiber. If you have known sensitivities to
plant fibers or natural latex, review the product materials
carefully before ordering, and contact us with any questions
before you buy.

REVIEWS, COMMENTS AND SUBMISSIONS
If you send us reviews, photos, comments, ideas or other material,
whether at our request or on your own initiative, you grant us a
nonexclusive, royalty free, worldwide license to use, reproduce,
modify, publish and display that material in connection with our
business, including in marketing. You confirm that the material is
your own, that it does not infringe anyone else's rights, and that
it is honest and reflects your actual experience.

We may edit submissions for length or clarity, and we may remove
any submission that is unlawful, abusive, misleading or otherwise
objectionable. We are under no obligation to publish or maintain
any submission. We do not offer payment or free product in
exchange for a positive review.

EMAIL AND TEXT COMMUNICATIONS
When you place an order, we send transactional messages such as
order confirmations and shipping updates. If you sign up for
marketing emails or texts, you consent to receive them at the
address or number you provide. Message and data rates may apply.
You can unsubscribe at any time using the link in any marketing
email, or by replying STOP to a marketing text. Opting out of
marketing does not stop transactional messages about an order you
have placed.

INTELLECTUAL PROPERTY
The MAREA Sleep name, logo, tagline, product names, site design,
photography, written content and all other material on the
Services are owned by us or licensed to us and are protected by
copyright, trademark and other laws. You may not copy, reproduce,
republish, sell or exploit any part of the Services without our
prior written permission. Nothing in these Terms grants you any
right to use our marks.

THIRD PARTY LINKS AND SERVICES
The Services may include links to, or tools provided by, third
parties. We are not responsible for the content, accuracy,
policies or practices of any third party, and providing a link or
tool is not an endorsement. Any transaction or dispute with a
third party is between you and them.

DISCLAIMER OF WARRANTIES
Except where prohibited by law, the Services and all products are
provided on an "as is" and "as available" basis, without
warranties of any kind, whether express or implied, including
implied warranties of merchantability, fitness for a particular
purpose and noninfringement. We do not warrant that the Services
will be uninterrupted, secure or error free, or that any result
obtained from using them will be accurate or reliable. Our Return
and Refund Policy sets out the remedies we do provide.

LIMITATION OF LIABILITY
To the fullest extent permitted by law, MAREA Sleep, EliteLink
Strategies LLC, and our officers, employees, contractors and
suppliers will not be liable for any indirect, incidental,
special, consequential or punitive damages, or for lost profits,
lost data or loss of goodwill, arising out of your use of the
Services or any product purchased through them. Where liability
cannot be excluded, our total liability is limited to the amount
you paid for the product giving rise to the claim. Some
jurisdictions do not allow these exclusions, so parts of this
section may not apply to you.

INDEMNIFICATION
You agree to indemnify and hold harmless MAREA Sleep, EliteLink
Strategies LLC and our affiliates from any claim or demand,
including reasonable legal fees, arising out of your breach of
these Terms or your violation of any law or the rights of a third
party.

SEVERABILITY AND TERMINATION
If any provision of these Terms is found unlawful or
unenforceable, that provision is severed and the remaining
provisions stay in effect. These Terms remain effective unless
terminated by you or by us. We may terminate your access at any
time if you breach these Terms, and obligations incurred before
termination survive.

GOVERNING LAW
These Terms and any separate agreements by which we provide you
Services are governed by the laws of the State of Florida, without
regard to its conflict of law rules. Any dispute will be brought
in the state or federal courts located in Miami Dade County,
Florida, and you consent to the jurisdiction of those courts.

CHANGES TO THESE TERMS
We may update these Terms at any time by posting a revised version
on this page. The updated version applies from the date it is
posted, and your continued use of the Services means you accept
it. Please review this page periodically.
